Disclosure of PHI to An Interpreter

The Department of Health and Human Services (DHHS) Office for Civil Rights (OCR) posted a new frequently asked question addressing the issue of whether a covered entity must obtain an individual's authorization to disclose PHI to an interpreter. OCR responded that a covered entity did not need to obtain an authorization to use an interpreter as long as the provider meets certain conditions. Under HIPAA covered entities may use and disclose PHI for treatment, payment, and healthcare operations without an individual’s authorization, and use of an interpreter falls under healthcare operations.
